Then he added in a more respectful tone, "Sir." " You are right Ensign, sorry if I've doubt about you decisions capabilities." Vladek replied seeing that he had probably frustrated the Brikkar. There was a moment of silence between them before Tagon began to speak again.  "Sir, no matter what happens, I want you to know what an honor it is to serve with you." "I could say too that it has been also an honor to have you under my command. And I can tell you that we'll make all in our possibilities to get you out of that." Vladek stated in leaving. Commander Wilson asked Peter what order the witnesses should follow.   "Well, I really think that Ensign Tagon should be last. We can use the rest of the witnesses to build up a profile for him and then apply it at the end. Give us a good deal of time to re-think our questions of him. Anyone who has a knowledge of Ensign Tagons psyche should be first, let us show him to be a true Starfleet officer and would not, willingly, commit a crime. After all, he is a security officer."   (Reply Wilson, iyw)   After they had finnished talking they took up their seats and waited for the trial to begin. Peter was rather on edge, this was his first stint at trial litigation. He looked around the 'court room' and notice that Commander Wilson was talking to a Captain Peter did not recognise. A short while later the trial began with the opening statements of both parties. Peter had several PADD's on the table in front of them, containing information on the witnesses, Ensign Tagon and the incident in question. He waited for any command from commander Wilson.   (Reply Wilson) (Posted by John Gibson) Stardate:2406.07.01 Mission: Opportunities of Engagements/For are Sins, Day 5 Stardate: 2406.07.01 (USS Cochrane - Ready Room - CO Lowell - 2032) "Come in!" The Ensign walked in. "Welcome on board Ensign Capps. I hope, you travelling over here wasn't too bad. I remember mine that was unique, I was drag by an unknown force deep in this quadrant not so far from here." "Site down... we have a few things to talk about." Alexandra extended her hand toward him and they shake. He was nervous but she knew that it was normal that she had that effect on the new members of her crew. "So, I can tell you that you have arrived at the right time, there's plenty of work for an OPS officer right now." (Reply from Capps) "I will try to make this story short. The Cochrane has been travelling for 3 months without much contact with Starfleet to after learn of what was going on. The fleet will move deeper in the quadrant, I don't know if you know what is going on in Starfleet... Do you?" (Reply from Capps) "I wasn't sure. Admiral LoDona accused another, Admiral Deonitz, of treason and vice a versa. The proof and indication that Admiral LoDona are of a certain weight that there's not much doubt and personal experience and even more the events of 3 months ago I would agree with him." (Reply from Capps) "3 Months ago, we rescued a federation family that had been kidnapped. The enemy was aware of why we were here, but it would seem that there sense of amusement took over and we took them by surprise. We succeeded to rescue them. The Collins family gave us and identify who kidnapped them in the first place, they were 2 federation officers who later on died in the explosion of a shuttle during a routine mission. Someone is covering up. We have found a message intercepter device that cut us off from Starfleet, so yesterday, we just learn about the move and we are in a rush to secure the Cochrane, that is what I want right now. It's highly important that we do so, we could have spies on board and I don't want to give them a chance then to leave. The marines and security people are doing this has we speak, but I want a follow up. Who ever officers don't want to follow the fleet, will have to be moved and sent back to earth for reasignment, they are very few but still there is. Do you understand Ensign Capps?" (Reply from Capps) "I know it difficult, and to be worse, I will not be as available. At 2200, I will leave for a court martial hearing where I am one of the judges... I don't know how long it will be. To add more, Lt. Comdr Tahlmari, the First Officer of the Cochrane, has is long lost family coming over and it's not an happy reunion for multiple reasons which are personal, but one I can tell is that the father, Erebou Tahlmari got shot. They are coming with the USS Discovery around 0200 hrs, my fiance's father is dying and it will become a murder investigation, keep a vigilant eye on the movements around the VIP quarters where the family will be set up. You have details on this padd. You can have more on the bio of Lt. Comdr Tahlmari." Alexandra gave it the padd. "What I told you, the details that Admiral LoDona gave us and your program for the next 3 days, maybe more. Any more questions?" Alexandra smiled. (Reply from Capps, anyone else that wants to talk.) Calvin sit down and while doing so the Captain reachead her hand out and they shook hands.   As Ensign Capps was shacking the Captain's hand, he notices his hand was white agiain.   "So, I can tell you that you have arrived at the right time, there's plenty of work for an OPS officer right now."   Calvin was not too shocked when he heard this comming from the Captain. The Ensign knew his job was going to be hard and alot of it. He had done some research on the USS Cochrane and knew there was only an OPS officer.   Calvin sitting as straight as a board, looked into the Captains eye's and said, "Captain, I will give you what you expect of me and more. Sir, I am ready for my duty on this ship.    The fleet will move deeper in the quadrant, I don't know if you know what is going on in Starfleet... Do you?"   I know that there is rumors of a civil war, but beyond that I have no clue.   "I wasn't sure.  Admiral LoDona accused another, Admiral Deonitz, of treason and vice a versa.   The proof and indication that Admiral LoDona are of a certain weight that there's not much doubt and personal experience and even more the events of 3 months ago I would agree with him." Calvin was hopeing he wasn't stepping the boundries or interupting the Captain, but Calvin said "If i may, Captain, it sounds like a fued between tow people. I went through four years of Starfleet Academy, and I was assinged here on the Cochrane under your command. I will follow your orders and the orders you follow. Maybe later, when I know more, I will decide differently, but by then I will have understood our side of the story, and I will stick with out side. That is what logic predicts." The Ensign stopped speacking, and tried to study if the Captain really cared what he had just said, but Calvin could not.   The Captain went on with what she was saying and Calvin listened very carefully to everything she had to say.   "Captain, I understood that you want to secure the ship, and find where everyone true loyalty lies. Captain, give me orders and I will follow them."   The Captain then gave more information to Calvin.   "I will be waiting for the USS Discovery to arrive, and I will keep a close eye on the VIP quarters, of the family."   Calvin reached over and took the PADD from his commanding officer. Wasting no more of her time, he said "aye Captain, is there any thing else."   (reply)   Calvin then walked out of the Captains ready room, preparing mentally for his duty.   (Reply CO Lowell, any one else) (Posted by Calvin Capps) Stardate:2406.07.01 Mission: Opporunities of Engagements/For are Sins, Day 5 Stardate: 2406.07.01 (USS Cochrane - Personal Quarters - Ensign Calvin Capps - 2035) "Captain Lowell to Ensign Capps... I would like to see you in my Ready Room, has soon has it is convenient", heard Calvin. He knew that he did not need to waste any of the Captains time. He answered back quickly "Aye Captain." Calvin took his last object out of his bag and just set it on the bed for now. He needed to get to the Captians Ready Room. Even though the Captain said when convenient he knew that she wanted him right away. Calvin quikcly went to the turbo lift down from his corridor. As he stepped in another ensign stepped out. Calvin quikcly told the computer "Bridge". It seemed as soon as he was done saying that the turbo lift had already stopped. The turbo lift doors opened, and Calvin stepped out, looking at the Bridge for the first time. He was amazed but his Vulcan kept him from smileing. No one turned around to look at him, but Calvin did not expect any one too. Calvin walked over to the Captains door, but before he did he fixed his suit quickly. While he was doing this he noticed that his skin color was green. Calvin has come to live with his green skin when his body tempertures rises, but this was the first time he would meet the Captain, he was hoping it would not happen. But for the Captain it could have been a good thing, surely the Captain realizes why Calvin skin is green and she would know that he is nervous because his body temperture has risen. Calvin though, knowing to stay focus, walked to the door and waited for the Captian to reply. "Come In" said the Captain "Welcome on board Ensign Capps" The ensing was a little surprised, the Captain did not seem distraught about his skin at all. Calvin thought that the Captain was very nice and friendly but at the same time get right down to business. She seemed tough and stern to him. Calvin then felt a little more comfortable. As the Captain replied to to him very well, the Ensign knew it would not belong before his skin would start turning back to its original white. He had preferred to wear it in another occasion, he wasn't knowing why but he had a bad feeling about this trial. He had taken some informations about Lt. Pitt, the guy assigned for the prosecution and his informants had told him that he was very good and that he hadn't lost a trial. Vladek was thinking that John, as defender, would need a strong dossier to save Tagon's head. It was time, he looked a last time at his uniform and went out. (Starbase Geneva, corridor - CO Captain Vladek Rofellian - 2150) On his way to the conference room, Vladek was thoughtful, he was preparing himself for the worst, if Tagon was declared guilty he would be certainly sentenced and send to a detention facility. It would be a setback for the Brikkar, he wouldn't certainly put up with the life in a prison. There was also another concern, the security onboard the station, with the move to the Beta Quadrant in an unknown sector, the security will be the first priority. The Security Department was already understaffed and if he had to do without the experience of Ensign Tagon, the situation would be more than worrying. Worrying but it was of secondary importance in regard to the future of the Brikkar. In entering in the conference room, he almost bumped into another officer "Captain." she said. Vladek recognized Captain Rhia, the CO of the Steel Talons, he had saw her yesterday on the ship's bridge when he had that discussion with the Admiral. " Captain Rhia, welcome to Starbase Geneva, I would have preferred to welcome you onboard on another circumstances." Vladek replied in letting her to enter first in the room. "After you, Captain." Lowell was already there, as some other officers, the prosecution and the defense team were already at their place. Rhia and Lowell were having a conversation and Lowell turned to Vladek asking "Getting there, yourself?" " I had to, I've spend all the afternoon looking at these juridical procedures, I didn't wanted to have learned all these things for nothing. And for you, how was it ? "  Vladek asked  "Not so bad, I had some sleep before reading all this.  I was up at 0630 this morning." Rhia nodded her head "Perhaps we should proceed?" she suggested. "Yes... Let's get to it!" agreed the CO of the Cochrane. "The sooner this masquerade will be over, the better." Vladek moaned in taking his seat. (Starbase Geneva, Conference Room - CO Captain Vladek Rofellian - 2212) Vladek had listened carefully the charges given by the prosecution against Tagon, followed by the defense opening statements. Then they had both questioned the only witness of the incident, the station's JAG Officer, Lt. Tybrin. Pitt was good, that was a fact, and he had won point, especially in playing in front of the court the holographic simulation of what had happened in the Mithrandir shuttlebay. The events that had happened in the shuttlebay, out of the general context of the previous hours, were completely unfavourable to the Brikkar. Then the defense had came up with an interesting theory about radiations inside the shuttlebay that could have affected the behavior of the Ensign. But at the end of the questioning of the JAG Officer, the all point was won by Lt. Pitt. Things weren't going good for his TAC/ASC and Vladek was moaning that he couldn't do nothing, still no news from the Crytonian government. Then suddenly his commbadge beeped, =^= Main Ops to Captain Rofellian =^=. He tapped his badge nervously " Ensign, I had told you that I didn't wanted to be disturb unless absolute necessity." =^= I know Captain but it's important, in other circumstances I would have called the FO or the 20 but seeing that you are all at the court martial =^= the Ops Officer explained. Vladek looked around " Commodore, Captains, I demand a ten minutes suspension to solve that problem." (Reply any)   (Starbase Geneva, outside the Conference Room - CO Captain Vladek Rofellian - 2215) " Rofellian to Main Ops, what is it Ensign ? " Vladek asked =^= Sir, we've just received a transmission from the subspace relay, it's from Cryton IV, they are saying that they've found what you've asked. They are currently transmitting the datas. I thought it was important. =^= stated the Ops Officer It was unexpected, just as the odds were against Tagon, maybe these informations could change the deal " You've done well Ensign but you've to hurry, transfer all the datas to the Padd and bring it immediately to the FO in the Conference Room." he ordered =^= Understood Sir =^= the Ops Officer replied " Oh Ensign one more thing, never we haven't had that conversation, is that clear ? " Vladek asked knowing that it was a trusted Officer =^= Perfectly clear Sir =^= And Vladek went back inside the arena.   (Starbase Geneva, Conference Room - CO Captain Vladek Rofellian - 2217) In entering Vladek went near the Counselor " Is everything all right Ensign ? During all the speeches, you've been immersed looking at that Padd and suddenly something seemed to have bother you ? " (Reply Johnson)   Vladek went back to his seat just as the doors opened, the Ops Officer entered and went near Wilson, he talked with him for a while then gave him the Padd he was holding. A smile of satisfaction appeared on Vladek's lips and he waited for the resumption of the debates. "No sir" Jon said hesitantly "Then let me ask you this," Pitt continued, "can you tell me when it is appropriate for the taking of a life." "When the individual is about to kill you or someone else and there are no other alternative." Jon replied. "Do you believe that any of those conditins were present at the moment of Colnel Lemssinx's death?" "Sir, at the time with the information I had, I saw no reason for Ensign Tagon to take Colonel Lemssinx's life." Jon admitted reluctantly. "And now, Lt., you believe that with the information you have you believe that it would be accptable to take a life?" Pitt did not wait for an answer. "Thank you Lt., that is all." Pitt turned on his heel and sat down. He could tell that he had won that point. He looked up to see the smile on the Commodore's face. It wouldn't be too long now. " So the only explanation I see is that his personal files are classified, it was certainly classified before he was assigned to the station." Vladek stated The Ensign held the PADD out to Vladek. "Take a look at this sir." Vladek took the PADD from him. "If you look the only thing I could pull up on Tagon's pass was that his father was a high ranking Brikkarian leader. Tagon was being raised to follow in his dad's foot steps. Instead he joined Starfleet after he was in a special operation unit." " Well it's not surprising when you look carefully at him, you see that he has the imposing bearing and the pride of a high rank person. The last thing in our mind would be to promise a threat. Instead I can safely say that the crew members were trying to get out of there. Not try to make Lemssinx mad so that he could hurt us more." " All we know is that Tagon was the last person on the Mirthandir's bridge to have resisted to these sonic waves, perhaps was he still conscious when Lemssinx had stepped on. We don't know what could have happened there, the same thing inside the Citadell, Tagon was detained in a separate cell with Morty, Morty had fallen rapidly unconscious, so no one knows what he could have undergo there too." " I don't think so, how it could be possible ? The Crytonian planetary system was only discovered after we were able to use the subspace river and if Tagon was knowing Lemssinx before, he would have told us that he wasn't an Ambassador as he had introduced himself." Vladek replied "The other thing that bothers me is that Tagon is an Asst. Tactical Chief. I did find that Tagon has had more training in his past at the finest military academies on his home planet. Tagon knew what he was doing when he killed Lemssinx. The question here is what happen in the past to make a loyal Starfleet crew member kill someone that was already caught." "I would like to know myself sir. The other thing sir is that you might want to know Tagon never did put Lemssinx under arrest." "I went throughout the holo-recorders and at no time did I see where Tagon put Lemssinx under arrest." " So what are your conclusions, Counselor ? " Vladek asked to know where he was coming to. He gave a smile to Vladek. "To me sir that would look like Tagon was acting under self defence when he killed Lemssinx since Lemssinx was shooting Tagon while he was down and defenseless." " It's a good hypothesis but now you just have to prove it. As I see, that Lt. Pitt is quite a good prosecutor, you've a tough opponent to contend with." Vladek stated "Well I thought I would try with that last part. But the stuff on that PADD about Tagon's past should at least head us in the right direction into what is going on." " So what are you going to do, if we can't access these informations, it won't help you a lot." Vladek asked seeing that the trial was about to restart "Well sir I'll take my seat and see what happens. Keep the PADD and see what you can do with the information. You might see something there I missed." " I would have liked to look at it Ensign, but I'm assigned here as Judge and if I do something that could think to the court that it would help the defendant, it will be an inadmissible evidence. (Reply Wilson) "Well sir I talked toVladek about Tagon and his personal files and how I could not get into Tagon's files.  I keep getting Access Denied.  I should be able to pull his file but I can't" (Reply Wilson) "I know that sir.  And again I'm sorry for having you leave the trail like you did.  But I talked to Vladek about the little information on Tagon's past and I believe that Tagon might have know Lemssinx before when even went to the planet." (Reply Wilson) "I know that that does not make since but the small information I have on Tagon and the other little details that are showing up.  I can't just leave this alone." (Reply Wilson) "Tagon has not had any problems at all while he has been in Starfleet.  But yet we go out on an away mission.  Something that Tagon I'm sure has been on before.  Just goes out and kills someone.  Someone that he had promised at some point in time to kill." (Reply Wilson) "Ok.  Fine.  But what about his past military training that Tagon has had before Starfleet and the Special Operation Unit he was asigned to before he joined Starfleet?" (Reply Wilson) "Look sir.  Vladek said that you were the one I should talk to about getting  using your help.  To use you security code to get into Tagon's personal files." (Reply Wilson) "Look sir all I'm trying to do is help Tagon out before the trail is over.  The sooner we try to figure this out.  The sooner we can give our findings to the  Judge." As the door closed behind them John threw his hands up and ran his hands through his hair. "Well that is not going well," Wilson began "It is going as a suspected it would." Tagon was calm. His apparent lack of concern was disconcerting to the two others in the room. "Gentlemen what are we going to do. Our main defence is around the radiation however that does not seem to be working. What the hell are we to do people?" Now the Brikar was beginning to worry. He did not understand why Wilson suddenly lost the enthusiasm of Tagon's innocence. Was it possible that he, too, was stating to believe him to be guilt of murder. But he remained silent. He had no idea as what to do. "I could go to them with a deal?" Wilson sugggested. "No!" Tagon replied emphatically. Then he said more calmly, "No, I do not want you to stop this trial. Something has happened and I need to know what. If I am guilty of murder I should punished as a murderer, and the trial should show that. If I am not then we can only see where fate leads us." "Ensign to be honest I think the murder I can get you off, but the conduct unbecoming is going to be a difficult one. The prosecution is focusing on the prior events to the murder stating he had motive in essence. The radiation can be blamed for a lot but the problem is you promised Lessimax you would kill him in front of witnesses. That is very bad Ensign." "I understand that Lt. Commander,"Tagon was encouraging, "and I have every confidence that you will give your best effort. But I'm sure that you too have noticed that there is something strange going on here. I cannot place what it is right now. But something is definately wrong with this situation." "At the moment I think they want to take you out there and nail you to a cross. I think if we offer them a deal, they at the moment, are wanting to make a example of you I think however if they can get your for conduct unbecoming they might concede the murder is not your fault. Ensign if you say to fight I will fight but all im saying is that the odds are not in our favour. You tell me to negotiate. I'll go to Pitt and negotiate, what do you want?" Tagon looked his superior officer square in the face. His full attention was on him. Every ounce of focus he had staring right into Wilson's eyes. The human squirmed a little at the gaze. "What I want, Lt. Commander," Tagon said, "is for you to go out there and give it the best fight you have in you. Find why,if we were in a combat situation, I'm being tried as a common criminal. At the very least, I should be under charges as a war crimnal." Wilson nodded but did not smile. They left the holding room and went back to the trial, to await what the start of their part in this trial. Jonathan Tybrin & Lt. Pitt- 22:25) Jon was highly agitated when he had gotten off the witness stand. Pitt seemed to be fixated on getting a conviction on Ensign Tagon and not on getting to the truth. It seemed as though Pitt had a alterior motive in convicting Tagon as he was not digging more into the obvious and stating things that had not been true. " Commodore, Captains, I demand a ten minutes suspension to solve thatproblem." Vladek announced "I don't have any problem with a 10 minutes recess." Alexandra had responded "No objections." Rhia also acknowledged. "Okay then, those proceedings will continue in 10 minutes." Vladek finally announced to everyone. Rhia sat forward, "The accused is not to be moved during this time. Counsel will stay with him, unless requested otherwise." This was just the break Jon needed to be able to talk to Pitt in private. Jon got up from his seat and looking at Pitt, "Follow me we have to talk now in private." "I really don't have time for this, Tybrin," Pitt replied, with little patience. His opinion of Tybrin continued to drop. "Lt. unless you want me to go to Blackburn, I suggest that you come with me now." Jon forcefully announced to Pitt as he started walking to a side room. Pitt glared up at his co-counsel and paused for a moment. He didn't believe that Tybrin going to Blackburn would give the stations JAG officer the result he would have expected. But he was curious as to what he had to say now. He got up and follwed Tybrin out of the conference room to a small side room. Once Jon entered the room he looked at the pictures untill he heard the door shut behind Pitt then he swung around to face him. "What in hell do you think you are doing out there?" Jon fumed "I'm doing my job," Pitt replied calmly, "which is more than I can say you are doing." "No! what you are suppose to be doing is getting to the truth, not convict just anyone." Jon angrily announced to Pitt. "You seem to be avoiding anything that goes against what you want to show. We are the Law here and if we dont uphold it by getting to the truth then we are no better than the ones we put behind bars." "Lt. Tybrin," Pitt raised his voice a litte, and then took a deep breath. "Do NOT suppose to tell ME what I am looking for. Simply because YOU are unwilling to accept the fact that Ensign Tagon did indeed murder that Crytonian, does not make it less of a fact. The question remains the same. If you had not thought what he had done was wrong, then why did you arrest him in the first place? Why did you send this report?" he threw a PADD on the table in front of them. "You say that I am supposed to be getting at the truth," Pitt continued, "but it is you who is avoiding the truth. Feeling a little guilty Lt.? Well that's just too damn bad. Get over it and grow up. There are bigger issues at stake here than your personal relationships." "Feeling Guilty? NO! I arrested the Ensign because it was my job and from the information I had it was the right thing to do. I sent my report because it was my duty and I still had no evidence that he was not in control of himself." Jon replied heatedly, "Unlike you I do not have any hidden agendas, I am out to get truth and justice done. You are suppose to be doing the same and you had better start or I will." "And one more thing Lt," Pitt added with menace in his voice, "do not ever..." he pointed a finger at Tybrin, "ever, threaten me again. I do not believe that you would appreciate the results." "Lt. I do not threaten, I act and you might not like the results if *I* do." Jon noticed that Vladek had reentered the room, "We need to return now and I warn you, do YOUR job the RIGHT way, get to the truth." Pitt & Commodore Blackford- 22:30) As Tybrin returned to the conference room he could see the commodre sitting at his table, looking somewhat pleased. The junior officer got Blackford's attention and he rose from his seat. As the commodore joined him, Pitt began o speak softly. "We have a problem," Pitt whispered. "Go on Lieutenant," Joseph stated whispering the same as the lieutenant. "Tybrin is not going along with our plan," Pitt continued. "In fact, he has promised to come to you with his complaints." "Well are you ready for the next stage," Joseph stated knowing what he was doing was close to high treason. "Of course I'm ready," Pitt was indignant. "I have been ready for this since that bastard declared open war. And I am prepared to do anything, including giving up my own life, to prevent this civil was if can." "Well what do you need?" "You get LaDonna to the trial, sir," Pitt said confidently, "I'll take care of the rest." "Of course I can handle that and make sure you deny all orders concerning this Pitt. We cannot be involved we do not want to turn him into a martyr." "Of course," Pitt replyed. He knew what was at stake. "I'll get the admiral here under the pretence that he is needed to show a united front. That is when you will have your chance." "Once he is there, I will do what is needed to be done." Pitt smiled and put his hand under his tunic. His fingers gently rubbed the weapon he had there. It was a nasty little weapon that was guaranteed to give LaDona something to think about as he died. "Ah the simplicity is laughable. And don't worry, command has given me authorization to do this. You will not be in the brig for long old friend." "I'm not worried, Commodore," Pitt said, seriously. "I'm ready for this charade to be over." Joseph turned back to the trial in at the main recess he was going to contact LoDona and get him down here. Pitt followed and re-entered the court room. He sat at his seat and once again felt the edges of his weapon. It gave him some amount of comfort and reminded him of what he had to do. Now it was simply a waiting game. The ten minute recess was over and Wilson had returned fromhis lttle emergency. Finally, they could get this trial back underway. he waited for the defense tocall their first witness.
